Research reveals responses of genes in females to sex

Sex can trigger remarkable female responses including altered fertility, immunity, libido, eating and sleep patterns - by the activation of diverse sets of genes, according to research from the University of East Anglia.

Publishing today in the journal Proceedings of the Royal Society B, the researchers studied how female Drosophila melanogaster - or fruit flies ? respond to mating.

They discovered that a single protein found in semen generates a wide range of responses in many genes in females, which become apparent at different times and in different parts of the female's body following mating.

The findings could in principle be akin to responses in many animals, including humans, where sperm and semen is released inside the female's body during sex.

Lead researcher Prof Tracey Chapman, from UEA's school of Biological Sciences, said: "It's already known that seminal fluid proteins transferred from males during mating cause remarkable effects in females ? including altered egg laying, feeding, immunity, sleep patterns, water balance and sexual receptivity.

"We tested here the effects of one enigmatic seminal fluid protein, known as the 'sex peptide', and found it to change the expression of a remarkable array of many genes in females ? both across time and in different parts of the body.

"There were significant alterations to genes linked to egg development, early embryogenesis, immunity, nutrient sensing, behavior and, unexpectedly, phototransduction ? or the pathways by which they see.

"It showed that the semen protein is a 'master regulator' ? which ultimately means that males effectively have a direct and global influence on the behaviour and reproductive system of the female. Such effects may well occur across many species.

"An additional and intriguing twist is that the effects of semen proteins can favour the interests of males whilst generating costs in females, resulting in sexual conflict.

"For example, there can be a tug-of-war, where males employ semen proteins to ensure that females make a large investment in the current brood ? even if that doesn't suit the longer term interests of females."

Calling the rangefinder-esque one-pound shooter small might seem off-base, especially considering the Zeiss Vario-Sonnar T* 35mm f/2.0 fixed prime lens protruding from its front, but it's not so huge (3-inches high by 4.5-inches wide) up against its tiny sibling, the RX100 -- taking into account how much larger the RX1's sensor is, well, that's when this editor's jaw basically dropped. While it's not a "pro-NEX" as many had hoped, Sony explained that it chose a fixed lens to avoid the bulk of a lens-mount. Official: 3 leads in grisly Alps killings

ANNECY, France (AP) ? Investigators are pursuing three leads in the killings of a British-Iraqi couple and two other people in the French Alps, but there are no suspects yet, a prosecutor said Wednesday. The leads include an alleged family financial dispute.

Meanwhile, relatives of the dead couple called for those responsible to be brought quickly to justice, saying they are "heartbroken" by the tragedy.

Saad Al-Hilli, his wife Iqbal, and an elderly woman were shot dead inside a car, while a French cyclist riding nearby also was killed. The couple's 7-year-old daughter survived but was badly hurt, while her 4-year-old sister was unharmed.

All four people killed suffered two bullets to the head among other wounds. The bodies were discovered by a British cyclist passing by who alerted police.

"At this point we don't have suspects, but just leads. And I can assure you that in this extremely difficult investigation it is hard to establish which lead is more important. It depends on what the investigators have," Prosecutor Eric Maillaud told a news conference in a downtown Annecy courtroom brimming with TV cameras and international reporters.

He said the three leads involve the alleged conflict between Saad Al-Hilli and his brother over an inheritance, though the brother in England denies any dispute; the professional lead of Saad Al-Hilli's work as a satellite communications engineer; and the geographical lead of Iraq, where the couple have roots.

"I would say that you have these three obvious areas to look at and they all need to be investigated with equal importance," Maillaud said. "But for the moment, we don't have anything that allows us to say with profound conviction that someone is guilty."

Maillaud said that the 7-year-old daughter is a "key witness" but likely won't unravel the case. She's still recovering and hasn't been questioned.

"When it comes to the probe we cannot base the outcome of the investigation on what a severely injured 7-year-old girl says," the prosecutor said, adding that the child is "in a delicate state as she regains consciousness."

After the press conference, Maillaud said that because of the family's use of English and Arabic the task of questioning the two young girls would be left to British authorities, who will use translators.

He also clarified that when the 4-year-old girl described hearing a shout that might have come from an assailant, it was not precise enough to ascertain any language. "What can you expect from a terrorized 4-year-old girl?" he added.

Maillaud said police had blocked off the forest road leading to the crime scene so that they could conduct some further tests on the ground to verify some of the things they learned from accounts they gathered of what happened. Two police stood guard in pouring rain beside several police cars, a van and a sign warning drivers in several languages that it is a "dangerous road."

In their first public statement, released through Britain's foreign ministry, Ahmed Al-Saffar said relatives of the dead are "heartbroken by this shocking crime." Al-Saffar was identified by the ministry as brother to the elderly woman killed in the attack.

The elderly woman has not been formally named, but the Sipa news agency has reported she is the Swedish-Iraqi mother-in-law of Saad al-Hilli.

"We hope that those responsible for the deaths of our loved ones are brought swiftly to justice," Al-Saffar said.

Astronomers spot flash on Jupiter

Astronomers are abuzz over sightings of a flash on Jupiter ? which suggests that the giant planet has taken another bullet for the solar system team.

Today's report follows similar sightings of impacts in 2009 and 2010. As in those earlier cases, the call has gone out to look for any visible scars on Jupiter's cloud tops. That would be a sure sign that an asteroid or comet was drawn in by the planet's gravitational pull, potentially saving us from a cosmic collision threat.

"It's kind of a scary proposition to see how often Jupiter gets hit," said George Hall, an amateur astronomer from Dallas who captured the flash on video this morning.


Hall didn't actually see the hit when it happened. Early this morning, he brought out his 12-inch Meade Schmidt-Cassegrain telescope with the Point Grey Flea3 video camera attached, just to capture imagery for a composite picture of Jupiter.?"Jupiter happens to be ideally positioned at about 6 o'clock in the morning," he explained. "It's right overhead."

That also just happened to be the time when another amateur astronomer from Oregon, Dan Petersen, made a visual observation of the flash. Peterson didn't capture an image of the flare, which lasted only a couple of seconds, but he did send his sighting report to other astronomers.

"I decided to just observe on this particular morning," he said in an email to Philippine amateur astronomer Christopher Go. "Had I been imaging I probably would have missed it while playing with webcam settings and focusing."

Go relayed Peterson's report to the Association of Lunar and Planetary Observers' Jupiter forum, which set the place buzzing.?Hall noticed the online hubbub and went back to review the video file on his computer. "I never would have looked" if it weren't for Petersen's report, Hall told me.?The time stamp on Hall's video matched up with Petersen's observations?? 6:35 a.m. CT, ?which is 7:35 a.m. ET or 11:35 GMT.

Hall reported his find, and shared in the accolades from fellow amateurs.

Universe Today's Nancy Atkinson quotes amateur astronomers as saying that the impact area should come back into view starting at about 1 a.m. ET Tuesday.?

Jupiter impacts are of great interest to astronomers, amateur and professional, because they're part of the orbital billiards game that has shaped our solar system. In some cases, the cosmic interloper is destroyed before it has any visible effect on Jupiter's cloud tops. In weightier cases, the object breaks up and leaves black marks on the planet's atmosphere. The case of Comet Shoemaker-Levy 9 in 1994 is the most notable in recent memory.

Beyond the planetary science, there's the "phew" factor: Astronomers suspect that giant Jupiter's gravitational pull serves as a cosmic shield, sweeping up incoming objects that would have a deadlier effect if they were to slam into our planet. Some scientists say that without Jupiter, life on Earth wouldn't have had much of a chance.

How big was the object that caused today's flash? Stay tuned: We may get a better fix on that once astronomers get a follow-up look. But Hall probably won't be among the legions keeping watch on Tuesday morning. He's lost enough sleep over the past couple of nights.

"I'm almost 70 years old," he told me, "and it takes a lot out of me to get up at 4:30 or 5."

Update for 1:25 p.m. ET Sept. 11: So far, observers have seen no conclusive sign of a scar left behind on Jupiter by the flash, going by the chatter on the ALPO Jupiter forum?and the Cloudy Nights website.

What?s the missing link we have needed to really be certain a housing recovery is here?

Home values and prices have been rising, the number of homes available on the market has been shrinking and some homes have been selling faster, so what?s been missing?

What we?ve been missing to concrete a rebound in the housing market is a real increase in the numbers of those buying a home.

The great news is that we are finally seeing home sales volume really pick up and the lag in data being published means we are now in a much healthier market than most realized. July also saw pending home sales figures jump to the highest level in 2 years and well about what it needed to call a healthy real estate market.

Of course national statistics need to be tempered with local trends, so while cities like Boston are seeing home and condo sales shoot up 27 to 34% others are certainly still finding their footing in the recovery.

The great news is that a recovery is contagious and all areas will eventually see more positive numbers, especially as we pass the election and the peak season for the South kicks in as we turn the corner in October/ November.

Sanctuary In Rhythm Of Honor CD

This is not your everyday CD, and it is not only the music that you will hear loud and clear. The story between the notes will hit home with force. The music is great and it drives all the messages straight to heart with feelings that are hard to describe without having some kind of personal experience related to the subject.

Bands and Professionalism, I view this is a very important topic. There are alot of bands that don't cross their T's and dot their I's. It's for the most part fairly easy to learn your part of the song on your instrument and perhaps your vocal part, but there are many other things to take into account for your live performances. Remember, you're being paid to do a job, and as fun as that job might be it is still in fact, a job. The venue owner or talent buyer is expecting you to come through with a quality performance. To start with, You want to arrive at the venue in plenty of time to set up and do your sound checks. Unless you really trust your sound man, you may want to have a long enough cord or a cordless system so you can stand out front and make sure all is well with the sound. Obviously there may need to be some adjustments when the place is full, but for the most part you should be in good shape.


For the performance itself, every band whether you're doing covers or origional material, your sound and stage presence or lack there of is what makes you and your show unique. Too much time (also known as dead air) between songs is definitely not good. For one thing, you tend to lose your audience's attention and you want to keep your momentum.You can avoid this by having a set list so you know what song is coming up next. You can also purchase equipment with memory that will allow your instruments effects to be up and running at the start of each song. You can have the last note of one song to be the first of the next song allowing you to run songs together in a medley. In many cases a song will start with one instrument so if you play that instrument and you know the timing well enough you can start right in providing the rest of the band is prepared for that. Of course, you want to have some interaction with the audience and each band according to it's personality will have it's way of addressing this. Relax and go with the flow. Just remember people are there for the music not for a speech.

Movies suffer worst box-office slump in a decade

LOS ANGELES (Reuters) - The North American box office hit a slump at the weekend, with top earner "The Possession" taking in less than $10 million and what could be the gloomiest overall haul since the aftermath of the September 11, 2001, attacks on New York and Washington.

With only a couple of new releases to tempt movie fans, horror movie "The Possession" pulled in an estimated $9.5 million in the United States and Canada.

That's the first time since 2008 that no film took $10 million or more at the domestic box office.

Early September is historically sluggish. After blockbuster releases over the summer, Hollywood studios reserve their big films for the November and December holidays.

But revenues for the three-day movie-going weekend were particularly low, with the total gross for all films expected to be $65-$68 million.

If the numbers hold when final figures come in on Monday, it could make the weekend the worst since September 21-23 2001 - two weekends after 9/11 - when revenue topped out at $59.7 million.

"It is pretty scary when the top movie comes in at only $9.5 million," said Paul Dergarabedian, box office analyst at Hollywood.com.

"This is one of the worst-grossing weekends of the last 10 years. In the summer, single movies had opening weekends bigger than this entire weekend gross," he added.

However, Dergarabedian said hope was on the way next week with the next installment of the "Resident Evil" horror franchise and the re-release of Disney/Pixar's 2003 family film "Finding Nemo," this time in 3D.

This weekend's lows follow a mixed summer that saw blockbusters like "The Dark Knight Rises" and "The Avengers" but a number of flops that led to a 5 percent drop in summer ticket sales in North America compared to summer 2011.

But in the year to date, the domestic box office is up more than three percent in revenue compared to the same point in 2011 and currently stands at $7.7 billion, with a 2 percent increase in attendance.

'OBAMA'S AMERICA' GAINS GROUND

Among the few notable spots was the anti-President Barack Obama documentary "2016: Obama's America." It boosted its cumulative total to more than $26 million to become the second-biggest political documentary since liberal filmmaker Michael Moore's 2004 anti-war indictment, "Fahrenheit 9/11."

New thriller "The Cold Light of Day" flopped with just $1.8 million. Lions Gate spokesman Paul Pflug, whose studio released the movie along with "The Possession" and "The Expendables 2," said the studio "went into the weekend with modest expectations."

"The Cold Light of Day," stars Henry Cavill, Bruce Willis and Sigourney Weaver in a story about a Wall Street trader whose family is kidnapped during a sailing trip in Spain.

It cost $20 million to produce. Distributor Summit Entertainment, a division of Lions Gate, reduced its risk through a co-financing arrangement with Intrepid Pictures, pre-sales of foreign rights and a production tax credit in Spain.

"The Possession," about a young woman possessed by a demon and starring Kyra Sedgwick, out-sold Prohibition-era crime drama "Lawless," which took in $6 million.

The only new movie to make the top 10 was romantic thriller "The Words," which earned $5 million. It stars Bradley Cooper and Zoe Saldana in the story of a writer who finds a manuscript in a 1940s briefcase and considers passing it off as his own. The film was produced for $6 million and acquired by CBS Films, a unit of CBS Corp, for $2 million.

Rounding out the top five, action movie sequel "Expendables 2" grossed $4.7 million domestically. Another action sequel, "The Bourne Legacy," rung up $4.0 million.

Lions Gate Entertainment released "The Possession" and "Expendables 2." "The Words" was distributed by CBS Films, a unit of CBS Corp. The privately held Weinstein Co released "Lawless." "Bourne Legacy" was distributed by Universal Pictures, a unit of Comcast Corp.

UK to fight energy product ruling

The government is to fight an EU ruling that the UK must raise VAT on energy efficiency products from 5% to 20%.

VAT was reduced to 5% on energy efficiency products in the UK because government wants to tackle fuel poverty, reduce carbon emissions and create jobs.

The reduction followed a long fight by green groups.

They argued that it was nonsensical to tax energy saving less than energy use, which incurs tax of just 5%.

But the Commission says the reduction on energy saving products breaches the VAT directive.

The directive allows for reduced VAT in several areas including water, food, audio books, restaurant service, gardening, nappies and energy itself - but not energy-saving products.

That is even though the commission's energy policy is to improve efficiency and cut carbon emissions.

The government says the VAT ruling is irrational and has confirmed that it will see the Commission in court, probably early next year.

The Climate Change Minister Greg Barker has started a Twitter campaign on the issue.

He told BBC News: "The Coalition's approach to energy efficiency is good for the environment and good for growth. Rather than obstruct us Europe should follow our example!"

It's part of a long-running tussle over VAT and energy between the Uk and Commission. Gordon Brown personally intervened on the issue.

But green groups are suspicious that the government may be trying to pick a populist fight with Brussels.

Keith Allott from WWF told BBC News: "On this issue the government is clearly in the right. There are many barriers to energy efficiency so reducing the tax is a no-brainer.

"But it's ironic in the context that the UK government has been stone-walling on key provisions in the energy efficiency directive."

WWF accuse the government of failing to support EU mandatory targets for energy efficiency and of watering down targets for renovating public buildings. The government insists that it played a positive role in negotiations.

(AP) ? Randy Moss found his way back to familiar turf, celebrating a touchdown at Lambeau Field in his new uniform.

The San Francisco 49ers' defense kept Aaron Rodgers and the Green Bay Packers out of the end zone for most of the day ? then made sure they didn't give the game away.

Showing the same brand of dominant defense that powered them to the NFC championship game last season, the 49ers smothered Rodgers and the Packers offense, then made one last stand to stop a late rally in a 30-22 victory on Sunday.

49ers linebacker Ahmad Brooks said the 49ers' win could be an "eye opener" for the Packers, and a sign that the 49ers are poised for another big playoff run.

"Maybe we'll see them again in the NFC championship," Brooks said.

Facing a Packers team that lost only once in the 2011 regular season was a tough opening road test, but the 49ers were more than ready.

"We were just tremendously on it today, and that was a big part of our victory," 49ers coach Jim Harbaugh said.

Things went so well for San Francisco that when David Akers tried a 63-yard field goal at the end of the first half, it bounced off the crossbar and then kept going through the uprights to tie an NFL record.

"When you hit the goal post at any part it usually makes that horrific noise and then it usually bounces back," Akers said. "This time it got there. It was a sweet bounce. It was definitely a once-in-a-lifetime type of a deal."

Alex Smith picked apart the Packers. He was 20 of 26 for 211 yards and two touchdowns, and Frank Gore rushed for 112 yards and a touchdown.

Moss scored on a 14-yard reception in the second quarter. He then turned his back to the crowd and pointed to the name on his jersey, opting for a more subdued celebration than the now-notorious fake mooning motion he made toward fans at Lambeau during his Minnesota Vikings days.

"He had a lot of juice, he blocked well," Harbaugh said. "He got open and he was a great big target in there."

The Packers came into their opener with hopes that a rebuilt defense and improved running game could help get them back to the Super Bowl after coming up short in the playoffs last season.

"They've got a great defense," Rodgers said. "You've got to give them credit. They've got some of the top guys in the league at their position."

Rodgers finished the game as the Packers' leading rusher, with new addition Cedric Benson gaining just 18 yards on nine carries.

The Packers don't have long to prepare for their next game, Thursday night at home against the division rival Chicago Bears.

Asked if he at least was pleased that his team put together a comeback, Packers coach Mike McCarthy held his tongue.

"Boy, I'd like to answer that truthfully," McCarthy said. "We're 0-1. We have some work to do. We're up in 96 hours."

Rodgers cautioned against blowing one loss out of proportion.

"It's one game," Rodgers said. "This is a team that was in the NFC championship last year. It's a good team. Hopefully we see them down the road in the playoffs."

Rodgers finished 30 of 44 for 303 yards with two touchdowns and an interception, but the 49ers held him in check until late the in the game. Jermichael Finley had a 1-yard touchdown for the Packers.

The replacement officials called a total of 18 penalties, some of them questionable and drawing animated complaints from both sidelines.

"Some of the penalties were definitely a little bizarre," Rodgers said.

The 49ers took a 16-point lead into the fourth quarter, then twice let Rodgers and the Packers cut the lead to 8. But the defense held firm on a potential game-tying drive in the final minutes

Randall Cobb gave the Packers a chance with a 75-yard punt return for a touchdown, and a 2-point conversion cut the lead to 8, at 23-15 in the fourth quarter. But Rodgers threw an interception to linebacker NaVorro Bowman, and Frank Gore ran for a 23-yard touchdown.

Rodgers then threw a touchdown to James Jones, cutting the lead back to 8.

With the clock nearing the four-minute mark, a sack by Clay Matthews helped force a punt and the Packers took over at their own 16-yard line with 3:37 left and no timeouts.

Rodgers steadily marched the Packers down the field, but Brooks sacked Rodgers. Facing fourth-and-10 near midfield, Rodgers threw deep toward Jordy Nelson but the pass fell incomplete.

Linebacker Patrick Willis said the 49ers made a statement.

"You turn on the TV or you hear people say, 'No, the Packers are going to beat them by two or three touchdowns,' and you hear everybody saying all this and that," Willis said. "But we know what we have and we have complete confidence in one another here across the board, offense, defense and special teams. As long as we have that and we're still together, I think we're capable of doing anything."

(AP) ? Robert Woods went over defensive backs and outmuscled them. He darted and cut through Syracuse, and made a huge play every time Southern California needed to shake free from the Orange.

The All-American receiver was so good, Matt Barkley's school-record six touchdown passes seemed almost pedestrian.

Woods was spectacular with 200 all-purpose yards and two scores, helping No. 2 USC (2-0) come away from a rare trip to the Northeast with a 42-29 victory against the Orange on Saturday.

"Each and every player on this team is trying to take over," Woods said. "When the game is that close, each player has that mindset, let's take over."

Wood did just that, and the Trojans needed a boost. They were choppy at times, and Syracuse's hurry-up offense kept them working hard for four quarters at MetLife Stadium, the home of the Giants and Jets.

Led by Ryan Nassib, Syracuse (0-2) kept things close with consecutive touchdowns in the third quarter to make it 21-16 heading into the fourth. Nassib finished with 322 yards passing, two touchdown passes and a touchdown run.

"That's the No. 2 team in the nation," receiver Alec Lemon said. "We put up a great fight against them."

But the Orange simply had no answer for Woods.

"Very frustrating. They have two great receivers, 2 and 9, Woods and (Marqise) Lee," Syracuse linebacker Marquis Spruill said. "They gave us a big problem."

Lee caught 11 passes and three touchdowns, but Woods made the game-changing plays.

He reached over a defender for a 29-yard score in the second quarter and boxed out a defensive back on a 4-yard touchdown in the third. He finished with 10 catches for 93 yards.

His best plays, though, didn't involve catching passes.

In the fourth, he grabbed punt on the run and raced 31 yards to the Syracuse 22. Barkley converted that into his fourth touchdown pass, when Xavier Grimble broke free of four Syracuse tacklers at the 10 and ran into the end zone to make it 28-16.

Woods capped his virtuoso performance taking a reverse around left end from the USC 20, cutting back across field and racing to down the sideline before being pushed out at the Syracuse 4, 76 yards later.

"It was set up pretty well," Woods said. "Hit the edge, great block from Marqise). Two cuts, and I just tried to race down the sideline. The guy had a good angle. It was pretty much set up with that Marqise block on the edge."

Barkley then found Lee, his other NFL-ready receiver, for a score to give him five touchdown passes against the Orange for a second straight season and a 35-16 lead with 11:38 left.

Nassib and Marcus Sales hooked up for their second touchdown of the game at 7:36, but at that point USC's offense, which was shut out in the first quarter, was rolling.

Barkley's sixth touchdown pass was a fade to Lee that Syracuse was all but helpless to stop. Barkley had six touchdown passes last season against Colorado.

He finished 23 for 30 for 187 yards, certainly didn't hurt his chances of returning to the New York area in December for the Heisman Trophy presentation ? and had a happy 22nd birthday.

"He got a Happy Birthday song from the team," Woods said. "He's probably going to get a lot of Twitter shout-outs later."

Then Barkley interrupted: "Had a couple of banana peels thrown at me."

The game at MetLife Stadium is the first of a bunch Syracuse plans to play there, as the Orange try to position themselves as New York City's college team.

A chance to see Syracuse try to pull off a massive upset wasn't much of a draw for Orange fans, however. The crowd was announced at 39,507, but there were plenty of empty seats in the two levels of the stadium that were used. And USC fans at the very least equaled ones for Syracuse.

Trojans fans on this side of the country haven't seen their team in these parts since 2000. USC was 2-1 in the old Giants Stadium from 1990-2000, and before that hadn't played in the New York area since 1951 when Frank Gifford led the Trojans to a victory against Army.

The weather surely didn't help fill the stadium either. The New York area was under severe weather warnings all day. The rain stayed away in the first half, but the start of the second was delayed to let a storm pass.

What did Barkley do during the delay?

"I put my feet up. Put my headphones on," he said.

It wasn't the best day by any means for USC's vaunted offense, but when in doubt, the Trojans could simply put the ball in the hands of one of their star receivers and get what they needed.

The best example came early in the third quarter on third-and-12 at the Orange 22. Barkley fired a quick screen left to Woods, who had lots of traffic in front of him. So he cut toward the middle, then raced across field before turning it up and away from the Syracuse defenders, diving for a first down.

A 12-yard gain hardly ever looked better.

A few plays later, Barkley zipped a pass to Woods to make it 21-3.

Syracuse responded with two touchdowns and just like that the 26-point underdog had the USC fans worried ? at least a little, and not for very long.

(AP) ? Restaurants and other businesses in this food-loving tourist mecca collected almost $14 million dollars in extra fees last year from their patrons, as they sought to comply with the progressive city's landmark universal health-care ordinance. But an Associated Press analysis of records show that roughly 40 percent of that money hasn't been spent on their workers' health care.

The surcharges, which range from 3 to 5 percent and often appear in fine print on receipts, are one result of San Francisco's five-year-old health care program, which includes some of the most far-reaching such requirements mandated by any U.S. city.

The law applies to more than 4,000 businesses with as few as 20 part-time workers, from nail salons to international banks with local branches, requiring them to set aside for workers an extra $1 to $3 an hour for health care.

The city's mandate is unrelated to the federal health care law that takes effect in 2014 and will apply only to companies with 50 or more employees. They could face fines if they don't provide coverage. And the IRS will collect the money, minimizing the chances of gaming the system.

In San Francisco, the fees have become a vexing issue for local officials, labor leaders and restaurants, whose owners say they are doing their best to comply with what many consider to be a confusing law with an admirable goal.

City officials say the vast majority of businesses in San Francisco go beyond what's required to make sure their workers have health care. But Donna Levitt, who is head of the city's Office of Labor Standards and Enforcement, said self-reporting by the 5 percent of businesses with surcharges last year confirms the city's suspicion that the money doesn't always go to health care.

There was nothing on the books in 2011 that required businesses to spend all the health surcharge money they took in. But a new law took effect this year requiring them to use the money for its intended purpose, or face a consumer fraud investigation.

In July, the San Francisco Civil Grand Jury raised concerns about abuse of the surcharges after looking at about three dozen restaurants jury members had patronized. It concluded many businesses were misleading customers into believing that every dollar was going to the health and well-being of workers.

"Most residents are socially conscious and embrace social changes, and paying a surcharge for employee health care is something we would readily agree to," said Mark Busse, a retired real estate agent who led the investigation. "But to discover they would make profits off surcharges really turned our stomachs."

The AP, through a public records request, later obtained names and health care expense breakdowns of the 172 businesses that reported imposing surcharges. There are likely even more that didn't file their numbers, city officials said. The records showed that 14 businesses collected at least $100,000 more than what they paid out for costs such as doctor's visits, medication and insurance. A third of the businesses spent less than half of what they collected from customers for health care.

In interviews, representatives of a dozen companies that collected more than they paid out denied hoodwinking anyone. Instead, they said the businesses are saving excess money for the future, or had workers who didn't fully take advantage of free money for medical expenses. Others disputed the figures they had filed, saying they were confused by the reporting requirements.

Celebrity chef Michael Mina, a business partner of tennis-legend Andre Agassi, owns high-end restaurants that include RN74 and a namesake eatery that was declared Esquire's 2011 Restaurant of the Year. Both spots reported collecting about $540,000 in health surcharges from customers last year while paying out about $211,000 in health-care money.

Paula Kaduce, a Mina Group controller, said the company worked hard, even held mandatory meetings, to get its workers to apply for reimbursement of medical expenses. But many of the 150 plus employees did not, although the company recently started seeing a bump in health care spending.

"Why they are not all excited about it like we are, I don't know," Kaduce said.

Some, like American eatery The Blue Plate, have ditched the surcharge. It raised $40,000 with the fee but spent only $500 in 2011. Co-owner Jeff Trenam said he noticed many of his young, healthy employees didn't have many medical expenses, so he stopped charging his customers for them. The company plans to use the extra money for future health care needs.

"No one really wants to feel like we are collecting money or charging guests in a way that is irresponsible or secretive," Trenam said. "That's not how we want to make our money or how most people want to make their money in this business."

Some local politicians and labor advocates say the gap between surcharges and health care spending reflects a wider problem, namely that businesses are skirting their obligations to pay workers' health care costs. The law doesn't say how money should be spent on health care. As a result, critics say many businesses set up accounts to reimburse medical expenses that disallow many types of them.

Ian Lewis, a representative for Unite Here Local 2, said his union has advocated for stricter employer health care spending rules, though its restaurant worker members receive benefits over and above the law's requirements. He said these reimbursement accounts "are structured so employees don't know they are there, and there are strict limitations on their use; and as a result, workers can't take advantage of them, which undermines very much the spirit of the law."

Records show more than $50 million set aside for workers were not paid out last year.

Squat and Gobble, a chain of five local restaurants, reported collecting more than $160,000 from its customers in surcharges but spending nothing from a reimbursement account for more than 80 employees in 2011. The company reported workers could not be reimbursed for services such as health insurance premiums and over-the-counter drugs.

The owner did not return calls for comment. Deisy Bach, whose company HR Ideas helps dozens of companies including Squat and Gobble comply with the law, said the company was among several clients who presented slideshows and updated their handbooks to instruct workers about their benefits, but employees may not have understood. "This restaurant has gone above and beyond to educate their people," Bach said.

Mayor Ed Lee signed legislation last fall requiring businesses to inform individual employees about their reimbursement accounts and keep left-over money available for workers for two years.

The 800-member Golden Gate Restaurant Association, which unsuccessfully fought the health care spending requirements in court, said it expects that new legislation will increase the amount spent on health care this year. The 2011 spending, said Executive Director Rob Black, "does not reflect at all how successful the amendments were at achieving goals set forth by the mayor."

William Dow, a University of California, Berkeley health economist who has studied San Francisco's health care law, said the disparity between what businesses have collected through surcharges and what they pay out is "striking."

"This seems as if they are bringing in funds under the guise of paying health care for employees and in fact that's not where the funds are going," he said.

However, Dow said it is too early to conclude companies are deliberately pocketing unspent money, because they could spend it on health care later.
